2. The Exhibit app

2.1 Data on your iPhone

To work, the app stores on your iPhone: your progress (tours, stops and objects you have seen, your answers, level, rooms, collection, milestones, the days you visited, Heist results and case files), your settings (sound, daily reminder), the archive ticket of the day, the membership status last reported by Apple and, if you enter them, a profile name and an emblem. To choose what “Keep exploring” shows after the day’s tour, the app also notes on your iPhone which rooms you spend time in and which objects it has shown you recently.

This data is kept in the app’s own storage on the device. The app does not send it to us or to anyone else, and we cannot access it. It is stored on your device because this is strictly necessary for the features you use (Section 25(2) no. 2 of the German Telecommunications Digital Services Data Protection Act, TDDDG). You can delete it at any time by deleting the app. Like the data of other apps, it can be part of your iPhone’s backups (iCloud Backup or a computer), depending on your settings; Apple’s terms and privacy policy apply to those backups.

2.2 Downloads, purchases and membership

You get the app from Apple’s App Store. The membership (a monthly or yearly subscription, or a one-time purchase for life) is sold and billed by Apple through In-App Purchase. Apple processes the data needed for this, such as your Apple Account and payment details, as an independent controller under its own privacy policy: apple.com/legal/privacy.

We do not receive your name, email address or payment details. The app uses Apple’s StoreKit to show prices, start a purchase and check whether a membership is active; this exchange takes place between your iPhone and Apple.

Apple gives us sales, subscription and trial reports, which contain no names, contact details or payment details. If you have allowed your iPhone to share analytics with app developers, Apple may also give us aggregated usage statistics and crash reports, which do not identify you. You can change this in Settings > Privacy & Security > Analytics & Improvements.

2.3 Notifications

If you turn on the daily reminder, the app asks for your permission and schedules a notification for 7:00 every day. If you start the free week of the yearly membership and allow notifications, the app schedules one reminder two days before the free week ends. These are local notifications: your iPhone creates and shows them, no push service is involved, and nothing is sent to us. You can turn them off in the app (You > Daily reminder) or in Settings > Notifications > Exhibit.

2.4 Links and sharing

Sources and other links open in your browser. The operators of those websites are responsible for the data processed there. If you share something, for example with “Challenge a friend”, the iPhone’s share sheet passes the text to the app or person you choose; we do not receive it.

2.5 What the app does not do

No advertising, no analytics, no crash-reporting services, no third-party code, no tracking across apps and websites, no use of the advertising identifier. No access to your location, contacts, photos, camera or microphone.

3. This website

3.1 Hosting on GitHub Pages

This website is hosted on GitHub Pages, a service of GitHub, Inc., USA. When you open a page, your browser sends technical data to GitHub’s servers, in particular your IP address, the time, the page requested and your browser’s identification. According to GitHub, the IP address of every visitor is logged and stored for security purposes. We have no access to these logs and do not use them. GitHub decides how long it keeps them.

The legal basis is Art. 6(1)(f) GDPR: our legitimate interest in publishing this website securely and reliably. GitHub is certified under the EU-U.S. Data Privacy Framework, so transfers to GitHub in the USA rely on the European Commission’s adequacy decision (Art. 45 GDPR). 3.2 No cookies, no tracking, no third-party content

This website sets no cookies, uses no analytics or tracking and runs no scripts. It loads nothing from other servers: the fonts are stored with the website. Links to other websites, such as Instagram, Apple or our legal notice, only connect you to them when you click. For our Instagram profile, see this notice.

4. When you write to us

If you write to us by email, for example to report an error, we use your email address and message only to answer you and to correct what you report. The legal basis is Art. 6(1)(f) GDPR, our legitimate interest in answering and in correct content, and, where your message concerns the use of the app, Art. 6(1)(b) GDPR. We delete your message once it has been dealt with, unless statutory retention obligations require us to keep it. Our mailbox is hosted by Gmail, a service of Google (Google Ireland Limited, Ireland, and Google LLC, USA); Google also processes your message in the USA. Google LLC is certified under the EU-U.S. Data Privacy Framework (Art. 45 GDPR).

5. Your rights

You have the right of access (Art. 15 GDPR), rectification (Art. 16), erasure (Art. 17), restriction of processing (Art. 18), data portability (Art. 20) and the right to object to processing based on Art. 6(1)(f) GDPR (Art. 21). Where processing is based on your consent, you can withdraw it at any time with effect for the future (Art. 7(3)). To exercise your rights, write to burolab.office@gmail.com. As the app sends us nothing, we usually hold no data about you from the app; the data on your iPhone is under your control.

Right to object: where we process data on the basis of our legitimate interest (Art. 6(1)(f) GDPR), you may object at any time on grounds relating to your particular situation (Art. 21 GDPR).

You also have the right to lodge a complaint with a data protection supervisory authority (Art. 77 GDPR), in particular in the EU member state where you live or work or where the alleged infringement took place. The authority responsible for us is the Hessian Commissioner for Data Protection and Freedom of Information (Der Hessische Beauftragte für Datenschutz und Informationsfreiheit), datenschutz.hessen.de.

There is no automated decision-making with legal or similarly significant effects (Art. 22 GDPR). What “Keep exploring” shows is chosen by the app on your iPhone, and that choice never leaves the device.

6. Changes

We update this policy when the app or this website changes. The date at the top shows the current version.

2. Die App Exhibit

2.1 Daten auf Ihrem iPhone

Damit die App funktioniert, speichert sie auf Ihrem iPhone: Ihren Fortschritt (gesehene Touren, Stationen und Objekte, Ihre Antworten, Level, Räume, Sammlung, Meilensteine, die Tage Ihrer Besuche, Ergebnisse im Heist und Fallakten), Ihre Einstellungen (Ton, tägliche Erinnerung), das Archiv-Ticket des Tages, den zuletzt von Apple gemeldeten Stand Ihrer Mitgliedschaft und, falls Sie sie eingeben, einen Profilnamen und ein Emblem. Um auszuwählen, was „Keep exploring“ nach der Tour des Tages zeigt, merkt sich die App außerdem auf Ihrem iPhone, in welchen Räumen Sie Zeit verbringen und welche Objekte sie Ihnen zuletzt gezeigt hat.

Diese Daten liegen im eigenen Speicher der App auf dem Gerät. Die App sendet sie weder an uns noch an Dritte, und wir haben keinen Zugriff darauf. Sie werden auf Ihrem Gerät gespeichert, weil dies für die von Ihnen genutzten Funktionen unbedingt erforderlich ist (§ 25 Abs. 2 Nr. 2 TDDDG). Sie können sie jederzeit löschen, indem Sie die App löschen. Wie die Daten anderer Apps können sie je nach Ihren Einstellungen in Backups Ihres iPhones enthalten sein (iCloud-Backup oder Computer); für diese Backups gelten die Bedingungen und die Datenschutzrichtlinie von Apple.

2.2 Downloads, Käufe und Mitgliedschaft

Sie laden die App aus Apples App Store. Die Mitgliedschaft (ein Monats- oder Jahresabo oder ein einmaliger Kauf auf Lebenszeit) verkauft und rechnet Apple per In-App-Kauf ab. Apple verarbeitet die dafür nötigen Daten, etwa Ihren Apple Account und Ihre Zahlungsdaten, als eigener Verantwortlicher nach seiner Datenschutzrichtlinie: apple.com/de/legal/privacy.

Wir erhalten weder Ihren Namen noch Ihre E-Mail-Adresse oder Zahlungsdaten. Die App nutzt Apples StoreKit, um Preise anzuzeigen, einen Kauf zu starten und zu prüfen, ob eine Mitgliedschaft aktiv ist; dieser Austausch findet zwischen Ihrem iPhone und Apple statt.

Apple stellt uns Berichte über Verkäufe, Abos und Testzeiträume bereit, die keine Namen, Kontakt- oder Zahlungsdaten enthalten. Wenn Sie auf Ihrem iPhone erlaubt haben, Analysedaten mit App-Entwicklern zu teilen, kann Apple uns außerdem zusammengefasste Nutzungsstatistiken und Absturzberichte bereitstellen, die Sie nicht identifizieren. Das können Sie unter Einstellungen > Datenschutz & Sicherheit > Analyse & Verbesserungen ändern.

2.3 Mitteilungen

Wenn Sie die tägliche Erinnerung einschalten, fragt die App um Erlaubnis und plant eine Mitteilung für jeden Tag um 7:00 Uhr. Wenn Sie die kostenlose Woche der Jahresmitgliedschaft beginnen und Mitteilungen erlauben, plant die App eine Erinnerung zwei Tage vor dem Ende der kostenlosen Woche. Das sind lokale Mitteilungen: Ihr iPhone erzeugt und zeigt sie, es ist kein Push-Dienst beteiligt, und es wird nichts an uns gesendet. Sie können sie in der App (You > Daily reminder) oder unter Einstellungen > Mitteilungen > Exhibit ausschalten.

2.4 Links und Teilen

Quellen und andere Links öffnen sich in Ihrem Browser. Für die Datenverarbeitung auf diesen Websites sind deren Betreiber verantwortlich. Wenn Sie etwas teilen, etwa mit „Challenge a friend“, gibt das Teilen-Menü Ihres iPhones den Text an die App oder Person weiter, die Sie auswählen; wir erhalten ihn nicht.

2.5 Was die App nicht tut

Keine Werbung, keine Analyse, keine Dienste für Absturzberichte, kein Code von Dritten, kein Tracking über Apps und Websites hinweg, keine Nutzung der Werbe-ID. Kein Zugriff auf Standort, Kontakte, Fotos, Kamera oder Mikrofon.

3.1 Hosting bei GitHub Pages

Diese Website liegt bei GitHub Pages, einem Dienst der GitHub, Inc., USA. Wenn Sie eine Seite aufrufen, übermittelt Ihr Browser technische Daten an die Server von GitHub, insbesondere Ihre IP-Adresse, die Uhrzeit, die aufgerufene Seite und die Kennung Ihres Browsers. Nach Angaben von GitHub wird die IP-Adresse jedes Besuchers zu Sicherheitszwecken protokolliert und gespeichert. Wir haben keinen Zugriff auf diese Protokolle und nutzen sie nicht. 4. Wenn Sie uns schreiben

Wenn Sie uns per E-Mail schreiben, etwa um einen Fehler zu melden, verwenden wir Ihre E-Mail-Adresse und Ihre Nachricht nur, um Ihnen zu antworten und das Gemeldete zu korrigieren. Rechtsgrundlage ist Art. 6 Abs. 1 lit. f DSGVO, unser berechtigtes Interesse, Anfragen zu beantworten und korrekte Inhalte anzubieten, und, soweit Ihre Nachricht die Nutzung der App betrifft, Art. 6 Abs. 1 lit. b DSGVO. Wir löschen Ihre Nachricht, sobald sie erledigt ist, sofern keine gesetzlichen Aufbewahrungspflichten entgegenstehen. Unser Postfach liegt bei Gmail, einem Dienst von Google (Google Ireland Limited, Irland, und Google LLC, USA). Google verarbeitet Ihre Nachricht dabei auch in den USA; Google LLC ist nach dem EU-US Data Privacy Framework zertifiziert (Art. 45 DSGVO).

5. Ihre Rechte

Sie haben das Recht auf Auskunft (Art. 15 DSGVO), Berichtigung (Art. 16), Löschung (Art. 17), Einschränkung der Verarbeitung (Art. 18), Datenübertragbarkeit (Art. 20) und auf Widerspruch gegen Verarbeitungen, die auf Art. 6 Abs. 1 lit. f DSGVO beruhen (Art. 21). Beruht eine Verarbeitung auf Ihrer Einwilligung, können Sie diese jederzeit mit Wirkung für die Zukunft widerrufen (Art. 7 Abs. 3). Um Ihre Rechte auszuüben, schreiben Sie an burolab.office@gmail.com. Da die App nichts an uns sendet, haben wir aus der App in der Regel keine Daten über Sie; die Daten auf Ihrem iPhone haben Sie selbst in der Hand.

Widerspruchsrecht: Soweit wir Daten auf Grundlage unseres berechtigten Interesses verarbeiten (Art. 6 Abs. 1 lit. f DSGVO), können Sie jederzeit aus Gründen, die sich aus Ihrer besonderen Situation ergeben, widersprechen (Art. 21 DSGVO).

Sie haben außerdem das Recht, sich bei einer Datenschutz-Aufsichtsbehörde zu beschweren (Art. 77 DSGVO), insbesondere in dem EU-Mitgliedstaat Ihres Aufenthaltsorts, Ihres Arbeitsplatzes oder des Orts des mutmaßlichen Verstoßes. Für uns zuständig ist der Hessische Beauftragte für Datenschutz und Informationsfreiheit, datenschutz.hessen.de.

Eine automatisierte Entscheidungsfindung mit rechtlicher oder ähnlich erheblicher Wirkung (Art. 22 DSGVO) findet nicht statt. Was „Keep exploring“ zeigt, wählt die App auf Ihrem iPhone aus, und diese Auswahl verlässt das Gerät nicht.

6. Änderungen

Wir passen diese Datenschutzerklärung an, wenn sich die App oder diese Website ändern. Das Datum oben zeigt den aktuellen Stand.

Nach oben
